Welcome to Avon Cars! These Terms and Conditions ("Terms") govern your use of the taxi services provided by Avon Cars ("we," "us," or "our"), a company based in Chippenham. By booking or using our services, you agree to be bound by these Terms. Please read them carefully.
1. Definitions
"Avon Cars": Refers to the taxi service provider.
"Passenger": Refers to any individual who books or uses our services.
"Driver": Refers to the licensed and vetted driver operating the Avon Cars vehicle.
"Vehicle": Refers to the taxi or private hire vehicle provided by Avon Cars.
"Booking": Refers to the reservation of a Vehicle for a specific journey.
"Fare": Refers to the cost of the journey as calculated by Avon Cars.
2. Booking and Confirmation
2.1. How to Book: Bookings can be made via telephone, our website, or any other method explicitly offered by Avon Cars. 2.2. Information Required: When booking, you must provide accurate and complete information, including: Pickup location Destination Date and time of travel Number of passengers Any specific requirements (e.g., child seats, wheelchair accessibility, extra luggage). 2.3. Confirmation: A booking is only confirmed once you receive a confirmation from Avon Cars, which will typically include a booking reference, fare estimate, and vehicle details (if available at the time of confirmation). 2.4. Amendments and Cancellations: Amendments: Any changes to a confirmed booking must be communicated to Avon Cars as soon as possible. We will endeavour to accommodate changes, but this may result in a revised fare. * Cancellations: Cancellations must be made within a reasonable timeframe prior to the scheduled pickup time. Late cancellations may incur a cancellation fee, as detailed in Section 4.5.
3. Fares and Payment
3.1. Fare Calculation: Fares are calculated based on various factors, including distance, time of day, traffic conditions, and any additional services requested. Our fares are transparent and will be communicated to you at the time of booking or upon request. 3.2. Quotes: Any fare quoted at the time of booking is an estimate. The final fare may vary due to unforeseen circumstances such as traffic diversions or additional stops requested by the Passenger. 3.3. Payment Methods: We accept various payment methods, including cash, credit/debit cards, and approved account payments. Payment details will be provided at the time of booking or by the Driver. 3.4. Payment Due: Payment for the journey is due upon completion of the service, unless otherwise agreed for account customers. 3.5. Additional Charges: Additional charges may apply for: Waiting time exceeding the free waiting period (typically 5-10 minutes, specified at booking). Excessive luggage requiring a larger vehicle. Cleaning fees for soiling of the vehicle. Toll charges, parking fees, and airport drop-off/pickup fees, which will be added to the fare. 3.6. Cancellation Fees: If a booking is cancelled less than [e.g., 30 minutes, 1 hour] before the scheduled pickup time, a cancellation fee equivalent to a percentage of the estimated fare or a flat fee may be charged. No-shows will be charged the full estimated fare.
4. Passenger Conduct and Responsibilities
4.1. Safety Belts: Passengers are legally required to wear seat belts at all times while the Vehicle is in motion. 4.2. Respectful Conduct: Passengers must treat the Driver and Vehicle with respect. Any abusive, aggressive, or inappropriate behaviour towards the Driver will not be tolerated. 4.3. Smoking and Vaping: Smoking and vaping are strictly prohibited in all Avon Cars Vehicles. 4.4. Alcohol and Drugs: Passengers under the influence of excessive alcohol or illegal drugs may be refused service for the safety of the Driver and other road users. 4.5. Damage to Vehicle: Passengers are responsible for any damage caused to the Vehicle by their negligence or wilful act. A cleaning or repair fee will be levied accordingly. 4.6. Luggage: Passengers are responsible for their own luggage. While our Drivers will assist, Avon Cars is not liable for any loss or damage to luggage. 4.7. Child Seats: If a child seat is required, it is the Passenger's responsibility to request it at the time of booking. While we endeavour to provide child seats, availability cannot always be guaranteed. Alternatively, Passengers may provide their own child seats.
5. Driver's Responsibilities
5.1. Licensing and Insurance: All Avon Cars Drivers are fully licensed and insured in accordance with local regulations. 5.2. Professional Conduct: Drivers will act professionally and courteously at all times. 5.3. Safe Driving: Drivers will operate the Vehicle safely and adhere to all traffic laws. 5.4. Punctuality: Drivers will endeavour to be punctual. However, we cannot be held responsible for delays caused by unforeseen circumstances such as traffic, road closures, or adverse weather conditions.
6. Limitation of Liability
6.1. No Liability for Delays: Avon Cars shall not be liable for any loss, damage, or inconvenience arising from delays in service due to circumstances beyond our reasonable control, including but not limited to traffic congestion, road accidents, adverse weather, or mechanical breakdown. 6.2. Indirect Loss: Avon Cars shall not be liable for any indirect or consequential loss or damage, including loss of profit, revenue, or anticipated savings. 6.3. Maximum Liability: Our total liability to you for any breach of these Terms or negligence shall be limited to the fare paid for the relevant journey. 6.4. Personal Belongings: While Drivers will take reasonable care, Avon Cars is not responsible for any personal belongings left in the Vehicle. We will make reasonable efforts to return lost property, but cannot guarantee its recovery.
7. Complaints
7.1. Making a Complaint: Any complaints regarding our service should be made in writing (via email or post) to Avon Cars as soon as reasonably possible after the incident. 7.2. Resolution: We will investigate all complaints thoroughly and endeavour to resolve them fairly and promptly.
8. General
8.1. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. 8.2. Jurisdiction: Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. 8.3. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 8.4. Entire Agreement: These Terms constitute the entire agreement between you and Avon Cars regarding the provision of our services. 8.5. Changes to Terms: Avon Cars reserves the right to amend these Terms and Conditions at any time. Updated Terms will be posted on our website.
